The criminal justice system exists to enforce the laws, and those who violate them are arrested. However, an arrest is just the first stage of a criminal case, so it is not a conviction. There are opportunities during the criminal process to fight the allegations and present defenses.
It is critical to always follow police instructions and never resist arrest. Do not answer questions or consent to interrogation, and avoid making any statements. You are entitled to advice from counsel, so contact your criminal defense attorney right away.
The court moves to the next stage, which is sentencing for the applicable offense. The penalties vary based upon felony versus misdemeanor charges, as well as your criminal record. After weighing all relevant factors, the judge will enter a sentence for jail time, fines, and other penalties.
Defenses depend on the specific nature of the crime, but they may include self-defense, lack of intent, mistake, or violations of your civil rights. Plus, there may be opportunities to plea bargain, in which case punishment is reduced in exchange for your guilty plea.
Your lawyer will take advantage of potential defenses at each stage of the process, starting with arraignment and bail for your pretrial release. You can count on your attorney to file motions, attack the government’s evidence, and work diligently to obtain a favorable outcome.
